This Privacy Policy (the “Policy”) is designed to help you understand Our policies and procedures regarding the collection, use, transfer, disclosure and/or deletion of Your Personal Data and information so you can make an informed decision about the Personal Data you provide to Us when You choose to use Our Services. BY USING THE SERVICES, YOU AGREE TO THE COLLECTION AND USE OF YOUR INFORMATION AND PERSONAL DATA IN ACCORDANCE WITH THIS PRIVACY POLICY.

Interpretation

 

Definitions

For the purposes of this Policy, the following terms shall have the following meanings and shall have the same meaning regardless of whether they appear in singular or in plural:

  • “Account” means a unique account created for You to access our Services or parts of our Services.

  • “Company” means Carrie Bedesky and its subsidiaries or affiliates.  The references to “I”, “We", "Us" or "Our" in this Policy refers to the Company.

  • “Cookies” means small files that are placed on Your computer, mobile device or any other device used to access the Services, either through a website, application(s) or otherwise, and contains certain details of Your browsing history on or use of the Services.  Cookies help to customize your content experience and to assist Us with improving the Services and learning which features of the Services are useful.

  • “Device” means any device that can access the Service such as a computer, a mobile phone, a digital tablet or any such similar device.

  • “Personal Data” means any information that identifies You, directly or indirectly, alone or together with other information such as your full name, email address, phone number, geographic location, network identifier, IP address, UUID, operating system, device type, system information, files viewed on our Services (such as HTML pages, graphics or images), system performance details, browser type, and other information regarding your individual use of the Services.

  • “Services” means any of the Company’s websites, live sessions, courses or events (in-person or online), mobile apps, social media platforms (Instagram, Facebook, Twitter, LinkedIn, or similar) and any other products, services, courses, or events offered by the Company through such other platforms or media.

  • “Service Providers” means any natural or legal persons We work with who process the data (including Your Personal Data) on behalf of the Company when you visit or access our Services or open emails that we send you, and includes third-party individuals or companies that work with the Company to facilitate, provide or perform other services related to the Services, such as marketing, data and usage analysis of the Services, and additional information related to Company’s products, promotions or offers.

  • “Social Media Service” means any social network website, mobile application or online portal or service through which a user can log in or create an account to access or otherwise use the Services.

  • “Usage Data” refers to any data collected automatically, either generated by the use of the Services or from the Services’ infrastructure itself such as the duration of a page visit or such similar usage details and information.

  • “Websites” mean any websites owned and controlled by the Company including, but not limited to: www,carriebedesky.com

  • “You” and “Your” means any person who is a visitor or unregistered guest that interacts, uses or otherwise accesses any of the Services or creates an account or profile for any of the Services of the Company or any other legal entity legally authorized to act on behalf of same, as applicable, and/or any other individual who receives a survey, questionnaire, application or other form of Personal Data request from the Company or individual who otherwise comments, reviews or posts content on any of the Services or participates in or in connection with any of the Services of the Company.

Types of Data Collected

 

Personal Data

We use Your Personal Data to provide, personalize and improve the Services.  While using the Services, You may be asked to provide Your Personal Data and other personal identifiable information that can be used to contact or identify You, including, but not limited to, Your: (i) first and last name, (ii) mailing address, (iii) email address, (iv) phone number, (v) Social Media Service used to access our Services, or (v) Usage Data.  We may also collect other information from You in connection with the use of the Services, such as Your purchase, attendance and participation history for live events, one-on-one sessions, products and other services, promotions, or contests.  We may disclose your Personal Data internally within the Company for marketing and/or other purposes in order to provide and improve the Services.

 

Usage Data

Usage Data is monitored and collected automatically when using the Services. Usage Data may include information such as Your Device's Internet Protocol address (i.e. IP address), browser type, browser version, web pages of Our Services that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.  When You access the Services by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device’s unique ID (i.e. UUID), the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data. We may also collect information that Your browser sends whenever You visit Our website(s) or when You access the Services by or through a mobile device.

Anonymous Data

From time to time, we may collect anonymous data from your Personal Data, Usage Data or other information in connection with Your use of the Services by excluding any data that makes the data personally identifiable to you, by employing a secure method to anonymize any such data.  In addition, we may share anonymous, non-personal, aggregate information regarding web traffic patterns and analytics, visitor demographics, customer sales, and overall website(s) usage with our Service Providers, third party internet advertisers and/or content publishers. Our use of such anonymous data shall not be subject to this Privacy Policy.

​Information from Third-Party Social Media Services

If You choose to register an account, login, use and/or otherwise access Our Services by linking to or otherwise granting us access to a third-party Social Media Service You are registered with, such as Google, Facebook, Twitter, Instagram or such other Social Media Service providers, We may collect Your Personal Data, information and details that are associated with such Social Media Service providers including Your account name(s), nickname(s), email address(es), contact list(s), and activities voluntarily provided and associated with those accounts such as comments, statuses, preferences, updates, likes, tweets, profiles, and so forth that is shared with Us from or through those Social Media Service providers (collectively “SMS Data”).  By registering, using, logging in and/or otherwise accessing the Services through Your Social Media Service provider, You are granting the Company permission to disclose, use, store and share such SMS Data in a manner consistent with this Privacy Policy.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track and store information of the activities of members, visitors and guests that use Our Services. Tracking technologies that may be used are beacons, tags, and scripts designed to monitor, collect and track information regarding users, traffic, activities in connection with the Services so we may analyze, improve and expand the Services We provide. These technologies may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You may be able to instruct Your browser to restrict or refuse to accept Cookies and/or otherwise notify You when a Cookie is being requested or sent.  However, by restricting the operation of such Cookies, You may not be able to use some parts of the Services.  Our Services may use Cookies if Your browser or device is not adjusted or set to restrict or refuse Cookies.  

Cookies may be: (i) “Persistent Cookies", or (ii) "Session Cookies”.  Persistent Cookies remain on Your personal computer or mobile device when You go offline while Session Cookies are deleted as soon as You close Your web browser.  Where applicable, the Services use Persistent Cookies and Session Cookies to make certain services and features available on our website(s) and enable You to use same.  Session Cookies are used to help authenticate users and prevent fraudulent use of user accounts.  Persistent Cookies are used to remember Your choices when accessing our website(s), such as remembering login details or language preferences, and are used to personalize Your experience and interactions with our website(s) and Services.

  • Flash Cookies. Certain features of our Services may use locally stored objects (“Flash Cookies”) to collect and store information about Your preferences and/or Your activities when using the Services. Unlike Browser Cookies, Flash Cookies are managed and controlled by independent, stand-alone third-party software applications (such as Adobe Flash Player, etc…) and are not controlled by browser settings. To adjust, restrict or delete Flash Cookies, we strongly recommend that You familiarize with the settings and features contained in such third-party applications connected and/or otherwise employed by the browser and mobile devices You use to access Our Services. 

  • Web Beacons. Certain sections of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that enable the Company to monitor web site information and details such as counting the number of users that have visited web pages, opened an email and/or tracking other related website data and statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Use of Personal Data

We use Personal Data for the following purposes:

Business Operations; Marketing.  We use the Personal Data we collect to operate our business and provide, maintain and improve the Services, as follows:

  • To manage Your account as a registered user of the Services. Registering for an account and logging in to use the Services may provide improved functionality and personalization when accessing the Services.

  • To provide customer support and diagnose and fix problems with the Services, as necessary.

  • To evaluate and improve our Services, conduct data analysis, identify usage trends, determine the effectiveness of Our advertising and promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience

Communication.  We use the Personal Data we collect:

  • To contact You, whether by telephone, email, text (SMS) or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or additional services, including software and/or security updates, as necessary and reasonably required for their implementation.

  • To attend and manage Your requests if and when you contact us with questions or concerns.

  • To provide You with news, special offers, contests, marketing, promotional campaigns, updates to our Services and other kinds of communications regarding Our goods, additional services and events we offer or those that You have previously purchased from Us and/or inquired about, unless You have opted not to receive such communications.

Compliance and Enforcement. We use the Personal Data we collect:

  • To enforce Our agreements, including Our policies and terms of service that govern Your use of the Services and, if applicable, for the preparation, undertaking and compliance with the terms and conditions of optional additional agreements that You may enter into with us such as purchase agreements for Our products, items or additional services (collectively, “Additional Agreements”).

  • To resolve any disputes in connection with the Services and any optional Additional Agreements We may enter into with You

  • To detect and prevent abuse, fraud and other unlawful or unauthorized activities

We may also use your Personal Data in any other manner as disclosed at the time of collection, or when We have otherwise obtained consent

The Personal Data We collect may be shared from time to time with Our affiliates and business partners and in certain specific circumstances.  We may share Your Personal Data and information in the following situations:

Provision of Services.  We share Personal Data for the following purposes:

  • With Service Providers.  We may share Your Personal Data and information with Service Providers to monitor and analyze the use of our Services and, if necessary, to contact You.

  • With Affiliates.. We may share Your Personal Data and information with Our affiliates, in which case we will require those affiliates to honour this Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

  • With Business Partners: We may share Your Personal Data and information with Our business partners to offer You certain products, services and/or to send promotional messages and advertisements about products and services that may be of interest to You, and for other purposes consistent with this Policy.

 

Structural Changes or Transfer of Business.  In the event of a sale, acquisition, merger, reorganization, divestiture, transfer or other similar structural change to Our business or in contemplation or evaluation thereof, or in the event of a bankruptcy, liquidation, dissolution or other similar proceeding, your Personal Data and information may be among the assets that are transferred.  In the event of a sale, acquisition or merger, We will provide a notice to inform You of same before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

 

With Other Users.  When You register an account or login to access the Services through a Social Media Service and interact with other users of the Services thereafter, Your contacts on the Social Media Service may be able to see Your name, profile, pictures and descriptions of your activities and communicate with You. Similarly, When You share personal information or otherwise interact (e.g. post comments, likes, status, etc…) in public (i.e. non-private) areas when You access the Services, such information may be viewed, shared, copies and distributed by other users outside of the confines of the Services.

 

With Your Consent: We may share Your Personal Data and information for any other purpose with Your consent.

Other Legal Requirements.  We may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation

  • Protect and defend the rights or property of the Company

  • Prevent or investigate possible wrongdoing in connection with the Services

  • Protect the personal safety of users of the Services or the public

  • Protect against legal liability

Retention of Personal Data

We only retain the Personal Data collected from you for as long as your account with Us is active or otherwise for a limited period for as long as necessary for Us to fulfill the purposes for which We have collected it unless otherwise required by law.  We will retain and use the Personal Data collected to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 

With regard to closed accounts, our retention policy is to keep backups of the contents of all closed or deleted accounts for up to six (6) months following the date of closure or deletion of such accounts.  With regard to billing, all billing information is retained for a period of seven (7) years from the billing date.

The Company may also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time except when this data is used to strengthen the security or to improve the functionality of Our Services.  We reserve the right to make adjustments to the above-noted retention periods as required by applicable laws, orders, governmental regulations and/or other legislative or regulatory bodies that have jurisdiction over our business activities.

Transfer of Your Personal Data

Your Personal Data is processed at the Company's operating offices in British Columbia, Canada, and in the regions where our Service Providers involved are located and maintain operations.  It means your Personal Data and information may be transferred to, and maintained on, computers and equipment located outside of the current location where the data protection laws may differ from those in Your jurisdiction.  By providing Your Personal Data in connection with the Services, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of the Company and our authorized Service Providers. We take steps to ensure that the data we collect under this Policy is stored and processed in accordance with this Policy regardless of where the data is located.  Our practice when transferring personal data is to rely on standard data protection contract clauses or individual consent.

The security of Your Personal Data is important to Us.  We also use, and require Our vendors to use, industry standard security protocols when processing any payments for Your use of the Services. However, it is important to remember that no system, method of transmission over the Internet or electronic storage is guaranteed to be 100% secure. Although We strive to use commercially acceptable means to protect Personal Data, We cannot guarantee its absolute security.  We do, however, recommend that you assist us with maintaining the security of your data by taking reasonable steps to avoid disclosing Your sensitive Personal Data in places that can be accessed publicly on our Services and by always keeping Your account information for our Services, including login details and passwords, private.

Our Services may contain links to other third-party websites that are not operated or controlled by Us. It is important to note that these third-party websites may supplement data collected or received in connection with the Services with data they collect or receive through other websites, platforms and services, in accordance with alternate policies and disclosures posted on those other third-party websites, platforms and services.  When You click on a link(s) that takes You away from Our website(s) and Services, You will be directed and subject to the policies and terms and conditions of those third-party websites, platforms and services. Please note that this Policy does not apply to those third-party sites.  As such, We strongly recommend and encourage You to thoroughly review the privacy policies of those third-party sites to obtain accurate information on how those third-party sites collect, use and share data thereon since We have no control over and assume no responsibility for the content, privacy policies or practices of any those third-party sites, platforms or services.

Changes to this Privacy Policy

We may update or change this Policy from time to time.  If there is a material change to the way we collect and use your Personal Data, We will send a notice of this change to all of our registered account holders in advance of implementing such changes.  Where applicable, We will notify of any changes by posting a prominent notice with a link to our new or updated Policy on our website(s).  We also advise and encourage You to review this Policy periodically for any updates, modification and/or changes.  Changes to this Policy are effective on the date they are posted on our website(s).
